Condition reports and/or Gemological reports in Auction catalog are guaranteed. It is the responsibility of prospective bidders to inspect the pictures and reports before bidding. All reports, measurements, opinion of values, age and quality are offered by Kissing Auctions. The Auction house is responsible for the accuracy of printed or verbal descriptions or its authenticity. All jewelry, Gemstones, Diamonds and Watches sold by Kissing Auctions are evaluated by in house certified Gemologists ( Experts ) and evaluate the weight, size and grade of gemstone and/or metal to determine the replacement / retail value of the item.

At present there is no Buyer's Premium Charged thus giving benefit directly to the buyers. All sales are final. Shipping Charges will be paid by the buyers and will depend upon the Value and the country specific.

Bidders agree to pay hammer price of the lot being auctioned. Bidding increments will be adjusted prior to start of auction. However, the auctioneer reserves the right not to follow it exactly as shown. Actual starting bids may be higher than shown on the internet due to  Kissing Auctions may change the starting bids to adjust to our bid increments.

Occasionally the Internet cannot keep up with the pace of our in-house auction. Placing a realistic Suspense / Absentee / Maximum bid prior to the start of the auction will insure that you bid on those items you most desire. IT IS AT THE AUCTIONEER'S DISCRETION TO ACCEPT OR REJECT AN INTERNET BID. In addition the auctioneer may reopen a lot after the close of an Internet bid and may reject your bid even if you are designated as the winning bidder. This is very rare but because of the pace of bidding, it is sometimes unavoidable. By bidding via the Internet, you agree that the lot may be awarded to another bidder at the sole discretion of Kissing Auctions under these circumstances or any other reasonable circumstances. Internet bids are not available to us until the lot is opened. 

Occasionally sellers will want a hidden reserves through Kissing Auctions to be placed on their items. Therefore, these lots will be deemed unsold/passed if the reserve has not been met. It is advised to bid Maximum to win.

Please be advised that all appraisals are done for insurance purposes only and do not determine the actual value of the Jewellery , Gem Stones , Diamonds and Watches at the auction. The appraisals are done for the sole purpose of protecting the buyer in the event of damage or loss of purchased jewelry items from Kissing Auctions.

Kissing Auctions is not responsible for the opinions and appraisals of any third party appraisal firms and their experts. Kissing Auctions and its representatives though fully claim expertise. Any condition statement is given as a courtesy to a client; it is only an opinion and should not be treated as a statement of fact. Kissing Auctions shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Any dispute of purchase must be made within 7 days of sale.

High and low estimates are provided solely for comparison purposes and for the auctioneers use only; Buyers should not use this figure as a true determination of value, or confuse an estimate with an appraisal. Kissing Auctions makes no warranties of any kind relating to them. 

Lots may have reserves or minimum selling prices. This confidential figure is set by Kissing Auctions. Kissing Auctions will exercise all reserve bids. The record of sale kept by the auction house is final if any dispute arises. Digital recordings of the sale will be used for confirmation.

All custom duties and other expenses in relation to the lot sent to the buyers country will be paid by the bidder or the buyer only as per the buyer's country's law.

Bidder shall be responsible for all costs of collection, including court costs and reasonable attorney's fees. By participating in Kissing Auctions through the internet, bidders consent to the jurisdiction of the Courts where the auctions are held.

All Photos, descriptions, and estimates are prepared with the utmost care by a fully certified expert and appraisers. All items in this sale are guaranteed authentic by our vendors. However photos may differ a bit but a sincere effort has been made to give true photos without use of filters. In the rare event that the item did not confirm to the lot description in the sale, Kissing specialists are here to help. Buyers may return the item for a full refund provided you notify Kissing Auction within 7 days of receiving the item.

BUYERS PREMIUM

At present there is no  Buyer's Premium charged in addition to the final sales price thus giving direct benefit to the buyers. By registering for this auction you are entering into a legal binding contract. Therefore, should you win your bid, you are obligated to pay.

DISPUTES/ CHARGE BACKS

By participating in Kissing Auctions, the bidder entirely agrees to the dispute resolution specified in the foregoing paragraph as the bidder's SOLE means to resolve any and all disputes which may arise with Kissing Auctions. By placing a bid the bidder specifically agrees that bidder will not file a dispute or charge back of any kind with an online venue, a credit card, or any other third-parties. Bidder specifically waives the right to initiate a credit card charge back dispute on any basis of claim and agrees that bidder will pay Kissing Auctions a minimum of $500 plus hourly charges and costs for any such charge back dispute opened, due to the severe administrative burden of such disputes and their direct violation of the dispute provisions above. In the event that Bidder violates this dispute resolution provisions, in consideration of Kissing Auction's approval of the application of the bidder to bid in Kissing Auction's auction, bidder confesses judgment to fraud having been committed by bidder against Kissing Auctions and further agrees that bidder is liable to Kissing Auctions for all damages, losses and costs, including time charges, resulting from charge backs or any claims.

In the event that you refuse delivery of the package for the completion of your order, at the discretion of kissing Auctions you will be liable for the 25% restocking fee based on the total hammer price paid.

All sales are final. In certain situations, if an exception is made, a RETURN MERCHANDISE AUTHORIZATION must be issued to return an item. Return can only be accepted on exceptional case only and will subject to verification. First Kissing Auctions must approve any return. Buyer is responsible for all return shipping and insurance. In the rare event of a cancellation, a 25% cancellation charge will be issued to the winning bidder.

Occasionally you may notice that an item is re-listed. This can be due to a variety of reasons such as a winning bidder in a previous auction not paying for the item, multiple types of the same item or it is one of the few items listed with a reserve and the reserve was not met. Most Jewellery comes from a jewelry manufacturing company / Whole sale dealers that carries multiple similar items.

PAYMENT INSTRUCTIONS

Invoices are emailed out within 24 hours following the auction. If invoice is not received by the 24 hours it is the winning bidders responsibility to contact Kissing Auction house to request another invoice. However, please check your spam folder prior to contacting us. Claim of non-receipt of invoice does not dissolve winning bidder of his/her responsibility to pay for item(s) won.

PLEASE READ: Due to recent credit card fraud charges, we ONLY Accept payments over 3000 $ through Wire Transfer only. We hold merchandise for till the funds are not cleared in our bank if paid with a personal/bank check or money order.  Payment is due within Seven days of receiving your invoice.

We accept wire transfers only for invoices over 3000 $ . All International bidders must pay via wire transfer for invoices in excess of $ 3000 unless prior arrangements have been made. We reserve the right to require a wire transfer on all purchases in excess of $3000 from bidders with whom we have not done prior business. Invoices less than 3000 $ can be paid by Credit / Debit cards / Pay Pal  for which invoice will be send to the buyer by e mail.
